1.1 These Terms of Use ("Terms") govern the use of the mobile application "fitElle" ("App") and all related services provided via the App or the website www.fitelle.app ("fitElle Services"). The fitElle Services are provided by sole proprietor Karin Schall, fitBilling, c/o Postflex #7152, Emsdettener Str. 10, 48268 Greven, Germany ("we", "us"). VAT ID: DE366916903.
1.2 In addition to these Terms, our Privacy Policy applies, available at www.fitelle.app/privacy-policy. It explains how we process your data, especially health-related and AI-generated data.

1.4 The App is intended for users aged 16 and older. Users under 16 may only use the App with the consent of a parent or guardian.

§ 2 Scope and Amendments
2.1 By using the App, you agree to these Terms.

3.1 The fitElle App is not a medical device and does not provide medical advice. It cannot replace consultation, diagnosis, or treatment by licensed healthcare professionals.

3.3 AI-generated content (e.g., nutrition advice, cycle insights) is created using available health data entered by the user. No warranty is given for completeness or accuracy.
3.4 The App is based on natural menstrual cycles. For users on hormonal contraception, predictive functions such as phase indicators may be inaccurate. This is explained during onboarding.
§ 4 Features and Functionality
4.1 The App includes free features (e.g., cycle calendar, symptom logging) and optional premium features (e.g., AI-generated insights, nutrition suggestions) available via subscription.
4.2 The App processes data you voluntarily input for personalization purposes. This data is stored anonymously and is not synchronized across devices or linked to your real name.
4.3 The App integrates AI services (e.g., Gemini, Groq) to provide personalized content. These services process pseudonymized data under strict data protection rules.
§ 5 Subscription and Payment
5.1 The App is free to download. Optional premium features are available via monthly or annual in-app subscriptions. Payments are handled through the Apple App Store or Google Play Store.
5.2 Subscriptions automatically renew unless canceled. Cancellation must be made directly via the respective App Store and is subject to their terms.
5.3 Consumers in the EU have a statutory right of withdrawal within 14 days. Due to the nature of digital services, this right may expire if the service is accessed immediately after purchase. The respective App Store terms apply.
§ 6 Liability and Availability

§ 8 Intellectual Property and Usage Rights

§ 9 Final Provisions
9.1 These Terms are governed by the laws of the Federal Republic of Germany, unless mandatory consumer protection laws in your country of residence provide otherwise.
9.2 Where legally permissible, the exclusive place of jurisdiction is the provider's registered office in Greven, Germany.
9.3 If any provision of these Terms is held invalid, the remaining provisions shall remain in full force and effect.
9.4 These Terms are available in German and English. In case of discrepancies, the German version shall prevail for users located in Germany; otherwise, the English version governs.
